12.3 No Responsibility of the Issuer. To the fullest extent permitted by applicable law, Fortune Gems, Digital Adamantine Pvt Ltd, Fortune Arts & Jewels Pvt Ltd, their affiliates, officers, directors, employees, contractors, advisors, and agents (collectively, the “DAMT Parties”) shall not be liable for, and disclaim any and all responsibility in respect of:
- Any loss, damage, cost, expense, penalty, fine, tax, claim, or liability arising from your acquisition, holding, transfer, use, or disposition of DAMT, including losses arising from price volatility, illiquidity, de-pegging, forks, smart-contract exploits, phishing, social-engineering attacks, SIM-swap attacks, compromised devices, or lost keys.
- Any breach by you of any law, regulation, sanctions regime, or tax obligation of any jurisdiction.
- Any action, inaction, determination, freeze, seizure, or investigation by any governmental, regulatory, tax, or law-enforcement authority in relation to you or your wallet.
- The availability, integrity, security, or conduct of any third-party wallet, exchange, bridge, custodian, oracle, node operator, block explorer, or other infrastructure that you choose to use in connection with DAMT.
- Losses arising from your decision to transact, to not transact, to delay a transaction, or to transact with any particular counterparty.
12.4 No Financial, Legal, or Tax Advice. Nothing we publish — including the white paper, yellow paper, website content, social-media posts, customer-support responses, or any statement by any DAMT Party — constitutes financial, investment, legal, tax, or accounting advice. You must consult your own qualified professional advisors before deciding to purchase, hold, or transact in DAMT.
12.5 Your Representations. By acquiring, holding, or using DAMT, you represent and warrant that: (a) you are of legal age in your jurisdiction and have full legal capacity to enter into this Privacy Policy and the Terms of Service; (b) you are not a resident or citizen of, and are not accessing the platform from, a restricted jurisdiction; (c) you are not a sanctioned person and are not acting on behalf of a sanctioned person; (d) you will comply with all applicable laws; (e) the funds you use to acquire DAMT are lawfully obtained; and (f) you understand the risks of blockchain technology and digital assets, including the possibility of total loss.
